How we handle copyright infringement claims and protect intellectual property.

Our Commitment to Intellectual Property

JustAbuja respects the intellectual property rights of others and expects all users to do the same. It is our policy to respond promptly to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.

Reporting Copyright Infringement

If you are a copyright owner (or authorised to act on behalf of one) and believe that content available on our website infringes your copyrighted work, you may submit a written DMCA takedown notice. Your notice must include all of the following:

Identification of the copyrighted work. A clear description of the copyrighted work you claim has been infringed.

Identification of the infringing material. The specific URL(s) or a detailed description of where the allegedly infringing material is located on our website.

Your contact information. Your full legal name, mailing address, telephone number, and email address.

Good faith statement. A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.

Accuracy statement. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on behalf of the owner.

Signature. Your physical or electronic signature.

How to Submit a DMCA Notice

Please send your completed notice via our Contact page with "DMCA Notice" as the subject line. We aim to review and respond to all valid notices within 5 to 10 business days.

Please note: filing a false or misleading DMCA notice may result in legal liability. Before submitting, please ensure that you genuinely believe the material infringes your copyright.

What Happens After We Receive Your Notice

Upon receiving a valid DMCA takedown notice, we will: promptly remove or disable access to the allegedly infringing material; make a good faith attempt to notify the party responsible for the content; and, where applicable, inform the alleged infringer of their right to file a counter-notice.

Counter-Notice Procedure

If you believe that material you posted was removed by mistake or misidentification, you may submit a counter-notice including:

Identification of the material that was removed and its location before removal.

A statement, under penalty of perjury, that you have a good faith belief the material was removed by mistake.

Your full name, address, telephone number, and email address.
4
A statement consenting to the jurisdiction of the Federal High Court of Nigeria, and that you will accept service of process from the original complainant.

Your physical or electronic signature.

If we receive a valid counter-notice, we may restore the removed material within 10 to 14 business days, unless the original complainant notifies us that they have filed a court action.

Repeat Infringers

In accordance with the DMCA, JustAbuja will, in appropriate circumstances, terminate access or disable accounts of users determined to be repeat infringers of copyright.

Good Faith and Fair Use

When reviewing DMCA notices, we consider principles of fair use and fair dealing. We encourage both copyright owners and content creators to consider whether the use of copyrighted material may constitute fair use before submitting a notice or counter-notice.
